Fox Aired Homan's 'No Plan' Denial. It Never Mentioned the DHS Secretary Said the Opposite.
On September 13, Tom Homan sat down on Fox News' own program, "The Sunday Briefing," and told host Jacqui Heinrich that claims about ICE at polling places were fiction. "There is no plan for enforcement action at polling places," he said. "It's just another attempt to smear ICE." Heinrich's on-air reaction — "That's news right there" — was treated as the story. Nobody on set brought up what the Secretary of Homeland Security, the Cabinet official whose department runs ICE, had said twelve days earlier.
On September 1, DHS Secretary Markwayne Mullin stood at a press conference in New York and described exactly the scenario Homan was denying. Asked whether ICE officers would show up at polling places, Mullin said yes, under certain conditions: "If we're serving a warrant, we will be where we need to be." That's not "no plan." That's a plan with a condition attached.
"No plan" and "we'll be there if we're serving a warrant" are not the same sentence, however you read them. One rules out federal agents at polling sites. The other keeps the door open and just specifies when they'd walk through it. Fox's own segment aired the first version as reassurance and never mentioned the second.
This isn't a minor wording gap. Civil-rights and voting-rights groups, including Denver's city clerk, LULAC, Common Cause and UnidosUS, have since filed multiple lawsuits over the prospect of armed federal officers at polling places, arguing it violates a voter-intimidation law that dates back to the Civil War era. Those lawsuits exist because Mullin's comment is also on the record — not just Homan's denial of it.
Other outlets covering this story included both men's statements side by side, letting readers see the contradiction for themselves. Fox's segment gave viewers only Homan's half, delivered as a scoop, with a surprised anchor vouching for how newsy it was.
We're not saying Homan's denial was false — maybe operational plans really don't exist yet. In our view, a network that spent twelve days without noting that the administration's own DHS secretary had said the opposite isn't reporting a denial. It's laundering one.
